Who Can a Muslim Marry? Understanding Islamic Guidelines |
Under Islamic law, Muslim men are permitted to marry “women of the book” (kitabia), in other words, Christian or Jewish women
(Quran 5:5)
- The Prophet’s صلَّى الله عليه وسلَّم third wife, Safiyya, was Jewish.
- The Prophet’s صلَّى الله عليه وسلَّم thirteenth wife, Maria, was Coptic, in other words, Christian.
Muslim men may marry a Christian or Jewish woman provided that she believes in God (Quran 2:221).
A Muslim man’s marriage to an atheist, agnostic or polytheist woman is prohibited in Islam (Quran 2:22).
Muslim women, however, may only marry Muslim men (Quran 60:10).
According to Islam, the only way to marry a non-Muslim man is for him to convert.
La conversion d’un futur époux non musulman reste la seule possibilité pour elle d’éffectuer un mariage selon l’Islam.
Essentials of a Muslim Marriage Contract with a Christian or Jewish Woman |
Except for the wife’s religion, which may create some unusual situations, a Muslim marriage contract with a Jewish or Christian woman is a Muslim marriage contract almost like any other.
The differences mainly have to do with inheritance (irth) and with custody of children (hadana).
One particularity involves the wife’s legal representative (wali).
If a Muslim man marries a Christian or Jewish woman, the wife must have a legal representative (wali) from her religion since a Muslim man cannot be the guardian of a non-Muslim woman, just as a non-Muslim man cannot be the guardian of a Muslim woman according to Allah’s word صلَّى الله عليه وسلَّم (Quran 9:71 and 8:73).
Although it is not always the case, this type of marriage may lead to certain difficulties due not only to differences in religion and culture, but also to differences in how children are brought up.
The Interfaith marriage contract offered by Nikahcontract.com takes into account issues related to religious and cultural differences. It offers future spouses the opportunity to consider their options and, if they desire, to customize their marriage contract to suit them.
And Allah عزّ وجلّ knows best
